OFFICIAL TERMS AND CONDITIONS
NO PURCHASE NECESSARY TO ENTER. Purchase will not improve chances of winning. Odds of winning will be determined by the number of eligible entries. Beautycounter National Lipstick Day Giveaway (“Beautycounter Giveaway”) is open to legal residents of the United States and Canada, including Quebec, who (at the time of entry) have reached the legal age of majority in their jurisdiction of residence. Beautycounter reserves the right to refuse to award a prize to or on behalf of a minor. To the extent permitted by applicable law, upon entering the Beautycounter Giveaway participants agree to waive any rights their jurisdiction of residence may provide in regards to sweepstakes or contests. The Beautycounter Giveaway is void where prohibited by law.
The Beautycounter Giveaway is in no way sponsored, endorsed or administered by, or associated with Instagram (the “Social Platform”). Instagram is hereby completely released of all liability by each entrant in the Beautycounter Giveaway. Any questions, comments or complaints regarding the Beautycounter Giveaway must be directed to Beautycounter and not to Instagram. You may only use one (1) Instagram Account (an “Account”) to participate in the Beautycounter Giveaway. To be eligible to earn an Entry (each, an “Entry” and collectively, the “Entries”) in the Beautycounter Giveaway, your Account must be set to public and not private.
HOW TO ENTER
Method 1: To be eligible to earn one (1) Entry, complete the following steps: (i) follow @beautycounter on Instagram; (ii) tag a friend in the comments of the post; (iii) share the post to your Instagram Story for an extra entry.
Method 2: Alternatively, to be eligible to earn one (1) Entry, print your first name, last name, telephone number, complete mailing address (including zip/postal code), age and signature on a plain white piece of paper and mail it (in an envelope with sufficient postage) to: “National Lipstick Day” Giveaway, 1733 Ocean Avenue Suite 400, Santa Monica CA 90401 (“Request”). Upon receipt of your Request, you will be eligible to receive one (1) Entry in the Beautycounter Giveaway. To be eligible, the Request you submit must: (i) be received separately in an envelope bearing sufficient postage (i.e. multiple Requests in the same envelope will be void); and (ii) be post-marked on or before July 29th, 2019 and received by no later than August 5th, 2019.
Entries will be accepted between July 29th, 2019 at 9am PST and August 5th, 2019 at 6:00pm PST. Selection of eligible winners will be completed in Santa Monica, CA on August 5th, 2019 at 6:00pm PST. Subject only to the approval of the Régie des alcools, des courses et des jeux (the “Régie”) in Quebec, Beautycounter reserves the right to amend the Beautycounter Giveaway dates at its discretion and without notice.
PRIZE(S) & SELECTION OF WINNERS
One (1) eligible winner will be selected at random on August 5th, 2019 in Santa Monica, CA at 6:00pm PST, to receive a “bundle” of products featured in giveaway, valued at $66 USD/$80 CAD. The “bundle” that consists of 2 lipsticks. Cash prizes will not be substituted in lieu of product prizes. Beautycounter reserves the right, in its sole discretion, to substitute a prize or a component thereof with a prize of equal or greater retail value.
HOW TO CLAIM PRIZE
Beautycounter will contact the eligible winners by direct message on Instagram. Beautycounter is not responsible for any changes to or discrepancies with contestant contact information. In any event where a winner cannot be located after reasonable efforts by Beautycounter, a new winner(s) may, in the sole discretion of Beautycounter and time-permitting, be selected.
FOR RESIDENTS OF CANADA ONLY: Prior to being confirmed as a winner, any eligible winner from Canada will first be required to correctly answer a mathematical skill-testing question without mechanical or other aid.
If an eligible winner: (a) cannot accept (or is unwilling to accept) the applicable prize (as awarded) for any reason; and/or (b) is determined to be in violation of these rules (including, for residents of Canada, failing to correctly answer the skill-testing question), then he/she will be disqualified (and will forfeit all rights to the applicable prize) and Beautycounter reserves the right, in its sole discretion and time permitting, to randomly select an alternate eligible winner.
DISQUALIFICATION AND PENALTIES
All participants agree to be bound by these rules. Beautycounter in its sole discretion, further reserves the right to disqualify any person for (i) violating any of these rules, (ii) tampering with the entry process or the operation of the Beautycounter website and/or the Social Platform, (iii) gaining (or attempting to gain) an unfair advantage in participating the Beautycounter Giveaway, or (iv) engaging in otherwise disruptive, annoying, harassing, or threatening behavior.
ADDITIONAL TERMS AND CONDITIONS
Subject only to the approval of the Régie in Quebec, Beautycounter reserves the right in its sole discretion to supplement or make changes to the rules of Beautycounter Giveaway at any time without notice. Beautycounter reserves the right in its sole discretion to interpret the rules of the Beautycounter Giveaway, and such interpretation shall be binding upon all participants. Beautycounter shall not be responsible for any administrative errors involved in the execution of any contest or sweepstakes. For Quebec Residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.
